Resolution regarding
Alston & Bird
February 25, 2005
Whereas Legal Aid of North Carolina is a state-wide, non-profit
law firm that serves the priority civil legal needs of low-income people in
North Carolina; and
Whereas Legal Aid of North Carolina does not have sufficient staff
and resources to meet all of the needs of indigents in our state; and
Whereas attorneys John Higgins, Frank Leak, Kevin O'Brien, and Anne
Randall, all of the firm Alston & Bird in Charlotte, North Carolina, rendered
exemplary pro bono services to clients referred by Legal Aid, which services
prevented homelessness of the clients' families and obtained substantial
compensation for their legal rights; and
Whereas the District Court of Mecklenburg County, in recognition of
the extraordinary quality of the representation so provided these clients,
awarded substantial attorney fees to Alston & Bird for their successful work;
and
Whereas Alston & Bird has now donated to Legal Aid of North
Carolina the equivalent amount of all such fee awards collected, an amount
totaling Seventeen Thousand Nine Hundred Seventy-one and 67/100 ($17,971.67),
It is hereby RESOLVED, that Legal Aid of North Carolina expresses
its great appreciation for the superior contribution of pro bono services and
financial resources by Alston & Bird;
Further, that Legal Aid of North Carolina has established a special
fellowship, in honor of the firm, Alston & Bird, with these contributed funds,
to augment the legal staff in its Charlotte office for continuing representation
of our most needy clients; and
Further, that Legal Aid of North Carolina declares its belief that these
extraordinary contributions represent the highest and truest examples of
professionalism in our great bar and give real substance to the ethical
obligations of North Carolina attorneys, as provided in the Revised Rules of
Professional Conduct of the North Carolina State Bar, Rule 0.1(7);
It is so resolved and adopted unanimously by the Board of Directors of Legal
Aid of North Carolina, Inc., this 25th day of February, 2005.
