Client Election Process
Note: This policy was recommended by the the LANC Board of
Directors' Client Eligibility Ad Hoc Committee and adopted on February
25, 2005 by the Legal Aid of North Carolina Board of Directors.
Client election process
- The Client Election process determines who may be eligible to
fill Client vacancies on the LANC Board. The LANC Board is
the final arbiter of selection and has sole discretion as to whom
is selected to sit on the Board.
- A Notice of Election shall be issued from the AO (LANC
Administrative Office) and the
LANC Clients Council
and sent to all affected
LANC Offices, Local
Advisory Councils, and to designated community organizations and
faith-based groups. The Notice shall fully explain the election
process and deadlines and how clients and others can participate.
The Notice shall be prominently posted in all affected LANC Offices
for the duration of the election process.
- Nomination notices and forms shall be disseminated widely in
the election area to LAC's, community and faith-based groups, and
made available to current, former, and prospective clients.
- Any person or organization receiving the Notice may nominate
a person who meets the geographical qualifications and who is willing
to be screened to determine the financial eligibility qualifications
and meet the other criteria determined by the LANC Board.
- Prospective Client Directors should be informed of the requirement
that they be screened for financial eligibility pursuant to the
Eligibility Policy.
- The Notice shall specify that nominations be sent to the AO
in the name of a Client Council member designated to monitor the
nomination process. A nomination form shall be created to
facilitate the process, but nominations shall be accepted in any
form.
- All persons nominated and found eligible under the guidelines
established by the Board for that specific election shall be placed
on the ballot.
- Only eligible prospective, current, and former clients, who
meet the geographical requirements are eligible to vote. Active
members of the Clients Council who meet the geographic requirements
are also eligible to vote. The Clients Council shall determine
"active members."
- Ballots shall be mailed to a place designated by the LANC Clients
Council in the name of a member designated to monitor the election
process. Ballots are to be opened only in the presence of
that person and another person designated by the LANC Board.
- The person receiving the most votes shall be referred for consideration
to the Nominating Committee. In the event of a tie, both persons
shall be referred. The Nominating Committee shall then determine
the selection process.
