Protection of a Grandmother…
A sample of cases handled by Legal Aid of North Carolina

Mrs. G is a widow in her eighties. Her niece contacted the Legal
Aid of North Carolina office in Gastonia and sought assistance with
a domestic violence matter. She explained that she felt that Mrs. G
needed legal assistance to protect her from her violent granddaughter,
who would soon be released from jail.
On several occasions Mrs. G had had to call the police to come to her
home because her granddaughter had become violent after using illegal
drugs. On at least one previous occasion, Mrs. G had obtained a domestic
violence restraining order to prohibit the granddaughter from coming
to her home. However, the granddaughter had physically taken Mrs. G
to the courthouse to obtain a dismissal of the order. Mrs. G became
increasingly afraid of her granddaughter.
The last violent incident resulted in Mrs. G being hospitalized with
a broken hip and lacerations. Although Mrs. G’s granddaughter was arrested
and jailed, Mrs. G feared that she would be released and return to Mrs.
G’s home. Therefore, she had called Legal Aid for help.
A Legal Aid attorney came to Mrs. G’s home to help her, since she was
homebound and in a wheel chair. The attorney assisted Mrs. G with the
completion and filing of the necessary papers to obtain a domestic violence
restraining order. Special arrangements were also made with the Court
to provide for Mrs. G’s needs.
At the hearing, a restraining order was obtained to protect Mrs. G.
from her granddaughter. This order provides that it may not be dismissed
without a special hearing before a judge with Mrs. G present.
"Legal Aid did a great job for my aunt," said Mrs. G’s niece. "They
got right on the case and did exactly what needed to be done for her."
